ORTOM VS TARZOO: Supreme Court Fixes January 15th for Final Rulling


January 15th fixed for ruling...
Read below the adoption of motions by both parties at the supreme court today...
 
 BARR HON URGES SUPREME COURT TO DISMISS TARZOOR'S APPEAL

Both Prince Terhemen Tarzoor and Governor Samuel Ortom appear at the Supreme Court in Abuja with a retinue of lawyers.
Seven judges of the court entered the courtroom at 9 05 am and the processes commenced.
Adebayo Adenipekun, a Senior Advocate of Nigeria, SAN, announced his appearance for the appellant with 29 other lawyers.
Adeniyi Akintola, also a Senior Advocate of Nigeria, announced his appearance with Governor Ortom, the first Respondent with 27 lawyers.
Sebastian Hon, SAN, appeared for the All Progressives Congress, APC, the second respondent, while Professor A A Ijohor announced appearance for the third respondent which is the Independent National Electoral Commission, INEC.
He too read a long list of lawyers appearing with him.
Adenipekun submitted that the case at hand was different from that of Zamfara because APC did not hold any primaries at all in Benue State in contravention of Section 177 of the Nigerian Constitution.
He submitted that the cross appeal should be dismissed and the appeal allowed to succeed.
Akintola is relying on last Friday's judgment with respect to nomination and submitting that the court cannot overrule itself and that the appeal should be dismissed.
In his ongoing submission Sebastian Hon stated that the appellant who relied on Section 87 of the Electoral Act 2010, (as amended ) at the Court of Appeal cannot change his case at the Supreme Court, and rely on Section 177 of the Constitution, and that oral submissions are not superior to pleadings.
Professor Ijohor urged the court to sustain its judgment of last Friday with respect to nomination exercises.
Justice Walter Samuel Onnoghen conducted proceedings and fixed January 15, 2016 for judgment.
